HOB COMMUNITY PLATFORM TERMS OF USE

The following terms of use (the “Terms of Use”) govern your use of this HOB Community Platform (the "Platform") published by CHANEL, a French company, whose registered office is located at 135 Avenue Charles de Gaulle, 92200 Neuilly-Sur-Seine ("Chanel").

Use of the platform

This Platform allows you in particular to access and watch exclusive and unreleased content of the Watches and Fine Jewelry Division of Chanel that are and must be treated as particularly confidential information of Chanel, and cannot be used outside the Platform without the express prior approval of Chanel.

The HOB Community Platform also allows you to connect and interact with certain other employees of Chanel, to post comments and upload images and videos as part of your comments (the “Content”) which may be published on the Platform and for you to chat, tag colleagues, reply to and “like” the Content published by your colleagues.

Images or videos which you include as part of your Content should be your own creation and should be in line with the CHANEL brand image and current CHANEL campaigns.

All Content submitted to the Platform will be viewable once published. If the Content does not comply with any of the Terms of Use, Chanel reserves the right, in its absolute discretion, to report the Content and submit it for review. Chanel will have the right to remove any Content that does not comply with the Terms of Use. In these circumstances, you will receive an email informing you that the Content has been removed.

You can contact Chanel to request deletion of any of your Content from the Platform at any time.

You can report any Content which you believe does not comply with any of these Terms by contacting Chanel who will review the Content and decide whether to remove it or not. If your Content is reported, you will receive an email informing you that your Content has been reported and the outcome of the review by Chanel. You also agree to not repost any of the Content on your own social media profiles or channels if the Content contains CHANEL products or promotes CHANEL products.

By submitting any Content to the Platform, you acknowledge and agree that:

The Content is your own work and that you are the sole author and owner of the intellectual property rights in the Content;
The Content has not been created by any third party and does not infringe any third-party rights; and
All "moral rights" that you may have in such Content (including but not limited to the right to be attributed) are voluntarily waived by you.

For any Content that you submit to the Platform, you grant to Chanel and its affiliated entities a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, duplicate, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such Content and/or incorporate such Content into any form, medium or technology throughout the world without compensation to you.

Forbidden activities

You understand and agree that it is forbidden to make any copy, capture, screenshot, or other recording or saving of the content available on the Platform.

You also understand and agree that it is strictly forbidden to act on the Platform or post any Content which is disparaging about Chanel its products and its brand and/or to the other users of the Platform and/or to any other third-parties, in any way or which does not comply with legal requirements, and notably that might constitute:

abuse, defamation, insult, harassment, impersonation, intimidation, invasion of privacy, breach of privacy rights, or any act that could harm a person’s or entity’s reputation (in particular of colleagues or third parties – clients, competitors, suppliers, or consultants);
sexual or moral harassment, or any other form of unlawful harassment under applicable law;
infringement of intellectual property rights;
circumventing protective technical measures;
diffusion of a virus, worm, Trojan horse, or any other malicious program;
direct communications not requested by the recipients (i.e. “spamming”);
violation of a trade secret, obligation of confidentiality, or non-disclosure agreement;
more generally, illegal, misleading or fraudulent activity, nor acting for an illegal or prohibited purpose.

If you breach any provisions of the Terms of Use, this could have serious implications for Chanel and you will be prohibited from using the Platform. It may also result in action being taken under Chanel’s disciplinary process (which depending on the severity of the breach may lead to a formal disciplinary sanction up to and including summary dismissal).

Privacy policy

By accessing the Platform, you agree that your personal data (including your name, surname, email address, photo, phone number) will be used by CHANEL to and during the time necessary to provide, manage, and monitor your access to the Platform and its contents. Your personal data may also be used by other user of the Platform solely for professional purposes.

Your personal data will be kept by Chanel on the Platform as long as it is necessary to provide, manage, and monitor your access to the Platform and its contents.

Intellectual property rights

The Platform is protected by intellectual property rights owned or licensed by Chanel and/or its affiliated entities.

The content of the Platform (such as texts, animations, images, videos, illustrations, diagrams, logos, trademarks, designs and models) are the exclusive property of Chanel and/or its affiliated entities.

The use of all or part of the Platform, especially by download, reproduction, transmission, presentation, or broadcasting is forbidden for purposes other than for receiving and benefiting from Chanel contents and services available on the Platform, and for CHANEL internal use only.

Chanel may freely modify the Platform, in particular its content, at any time and without notice.

Access to the platform

Your access to the platform is strictly personal. Chanel reserves the right to suspend your access to the Platform at any time without notice if Chanel has reasonable grounds to believe you have breached any of the Terms of Use. Your access will also be removed when you leave the employment of your employer. If you wish for your profile and all previously published Content to be deleted from the Platform, please make this request to Chanel.

Guarantees and liability

Chanel makes every effort to ensure that the information accessible on the Platform is accurate, complete and up to date. However, Chanel gives no guarantee whatsoever that this information is accurate, complete and up to date. Chanel does not give any express or implied guarantee concerning all or any part of the Platform.

Chanel may not in any circumstances be held liable for any direct or indirect damage, whatever its cause, origin, nature and consequences, arising out of the consultation or use of the Platform. In particular, Chanel disclaims all liability for any interruption or inaccessibility of the Platform, any occurrence of bugs or any damage resulting from fraudulent acts by third parties (such as intrusion) from the Platform.

Chanel has put in place means intended to ensure the security of the files composed from the personal data collected on the Platform. Chanel has no control over risks in connection with the functioning of Internet and draws your attention to the existence of potential risks arising in terms of confidentiality of the data transiting via this network.

This statement may be modified at any time. are subject to change at any time. These modifications are deemed to be accepted when you access the Platform. We recommend that you consult this page regularly.

Governing Law and Disputes

These Terms of Use are governed by French law without depriving you of the level of protection provided by the provisions of the mandatory laws of the country of your usual residence. Failing amicable agreement, the French courts in Paris have territorial jurisdiction for any dispute relating to the Platform, notwithstanding your option to bring the dispute before a competent foreign court of your choice.
